Salary and Bank Account Seizure in Izmir: Exempt Assets and Objection

In an enforcement proceeding initiated against a debtor, the creditor may seize the debtor's salary, bank account or other assets in the debtor's estate under certain conditions to collect the debt. However, in our legal system, certain assets and rights cannot be seized in order to ensure the debtor's livelihood. How Does the Seizure Phase Arise?

In enforcement proceedings, a payment order is served on the debtor. If the debtor does not object to the payment order or the objection is removed, the enforcement becomes final and the creditor may request seizure. In the seizure phase, the creditor may seize the debtor's salary, bank accounts, movable and immovable assets. Seizure proceedings are conducted through the enforcement officer. When the debtor learns that exempt assets or rights have been seized, they may apply to the Enforcement Court through a complaint within the statutory deadline.

The One-Quarter Rule for Salary Seizure

The salary, which is the most important income in the debtor's working life, cannot be seized without limit. By law, one-quarter of the salary can be seized; the remaining three-quarters is exempt from seizure to protect the debtor's livelihood. This rule also applies when there are seizures by multiple creditors; seizures are ranked and each rank cannot exceed the one-quarter limit. For alimony creditors, this ratio can generally be set higher, as alimony is a priority and special type of claim. For debtors with multiple salaries, the assessment is made on the total of all salaries.

Retirement Pension and Bank Account

Retirement pensions are generally exempt from seizure by law. This protection is intended to preserve the retiree's basic livelihood. However, there are two important exceptions: the debtor's explicit consent to seizure of the pension and alimony claims. Outside these exceptions, it is not possible to seize a pension payment; therefore, a debtor who learns that their pension has been seized must file a complaint with the Enforcement Court within the statutory deadline. When it comes to a bank account, the source of the amount in the account is decisive; the protection must be asserted for amounts in the nature of deposited pension or salary payments. Keeping the relevant documents (salary receipts, account statements) complete is important in the objection process.

Exempt Assets and Homestead Claim

The law has placed certain assets and rights that provide for the debtor's livelihood within the scope of exemption from seizure. The debtor's home appropriate to their circumstances (homestead), basic household furnishings, tools and equipment necessary for practicing their profession, essential clothing for personal use, and agricultural tools and animals under certain conditions are examples of assets and rights within this scope. The homestead claim for a 'single home appropriate to one's circumstances' in particular is a frequently invoked legal route in practice. However, the value of the home must be proportionate to the debtor's economic situation and social status; an excessively luxurious building being one's only home does not always validate a homestead claim. Additionally, if a seizure is placed on an asset belonging to a third party found with the debtor, the true owner may file an ownership claim (istihkak action) to recover the asset.
